The orderbird KassenSichV guarantee
The cash register security regulation (KassenSichV for short) has been in force since 2020. Every electronic POS system had to be equipped with a TSS by 31.12.2022. orderbird remains tax office compliant for these requirements too. We assure you of this with our guarantee declaration.
We guarantee:
The orderbird POS system is guaranteed to meet the requirements of the cash register security regulation (KassenSichV) and your data is safe from manipulation. Still receive a fine for a breach of the KassenSichV because of our POS? We will pay the penalty!
Conditions of the guarantee:

Until the online TSS receives final certification from the German Federal Office for Information Security (BSI), this requires an exemption notice from your responsible tax office in response to your application under Section 148 AO.

This requires the use of the latest version of the orderbird software at all times, as well as the necessary hardware, including activation of the technical security system (TSS) offered by orderbird and provided for by law.

The guarantee applies only to revenue that was actually recorded in the orderbird POS and transferred to our servers. The POS operator alone is responsible for recording revenue correctly and completely and for issuing and providing receipts correctly.

The guarantee also applies only to cases that are demonstrably attributable solely to failings of the POS system itself and not to those of the POS operator or of third parties.

Persons with previous convictions for illegally intruding into or disrupting third-party computer systems are excluded from this guarantee.

A guarantee claim must be asserted with orderbird within 4 weeks of the event by sending in the expert report from the POS audit. Consequential damage or wasted expenditure is expressly not covered by the guarantee.

The customer's existing statutory or contractual claims (claims for defects) are not affected by the guarantee.
What is the KassenSichV?
The three key statutory requirements of the cash register security regulation at a glance:

1. The technical security system (TSS)
The technical security system (TSS) makes digital inspection by the tax office possible. The data is stored unchanged in the process. This is intended to rule out subsequent changes or manipulation.

2. Obligation to issue receipts
The obligation to issue receipts means that you have to provide every guest with a receipt. The guest decides for themselves, however, whether to take it or not.

3. Obligation to report POS systems
The obligation to report POS systems means that the tax office must be informed about every POS system used in the business. This also applies when POS systems are no longer used.
